Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Grabitchat website, dashboard, and ordering services (the "Service") provided by Grabitchat ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Grabitchat lets businesses ("Merchants") take and manage orders through WhatsApp and a web storefront. We provide the software; Merchants are solely responsible for their products, prices, content, fulfilment, and dealings with their own customers.

2. Accounts

• You must provide accurate information and keep your credentials secure.
• You are responsible for all activity under your account.
• You must be legally able to enter into these Terms and to run your business.

3. Acceptable use

You agree not to use the Service to:

• Break any law or infringe anyone's rights.
• Send spam or messages that violate WhatsApp's or Meta's policies.
• Sell prohibited, unsafe, or illegal goods.
• Interfere with, disrupt, reverse-engineer, or gain unauthorized access to the Service.

Your use of WhatsApp through the Service is also subject to the applicable Meta and WhatsApp Business terms and policies.

4. Fees & billing

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing with prior notice; changes take effect at your next billing cycle. Grabitchat charges no commission on your sales.

5. Merchant content

You retain ownership of the content you upload. You grant us a limited licence to host and display it solely to operate the Service. You are responsible for ensuring you have the rights to all content you upload and that it is lawful.

6. Intellectual property

The Service, including its software, design, and trademarks, is owned by Grabitchat and its licensors. These Terms grant you no rights in our intellectual property beyond the right to use the Service.

7. Third-party services

The Service integrates with third parties such as Meta / WhatsApp and payment processors. We are not responsible for those services, and your use of them is subject to their own terms. WhatsApp is a trademark of Meta Platforms, Inc.; Grabitchat is an independent product and is not endorsed by or affiliated with Meta.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others or to the Service.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Grabitchat will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnity

You agree to indemnify Grabitchat against claims arising from your content, your products, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be posted here with a new "last updated" date; continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules.
